Terms and Conditions

1. Eligibility

• You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or guardian.
• By using the Service, you represent that you meet these requirements and that all registration information you provide is accurate and complete.

2. Free Credits and Promotions

• Upon signing up, each new User will receive $5.00 in Free Credits to use toward hosting services.
• Free Credits:
  • Are non-transferable and have no cash value.
  • Expire 30 days from the date of issuance if unused.
  • May be revoked if we suspect abuse, including but not limited to multiple account creation.
• Promotions and trials may be offered at our discretion and are subject to these Terms.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• If you suspect unauthorized access, you must notify us immediately.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments, Billing, and Upgrades

• Billing: Paid hosting plans are billed in advance on a monthly basis.
• Upgrades: Upgrading your plan takes effect immediately, and charges are prorated.
• Downgrades: Downgrading may reduce your allocated resources; we are not responsible for data loss caused by downgrades.
• Renewals: Unless canceled, subscriptions renew automatically at the end of each billing cycle.
• Late/Failed Payments: Failure to pay may result in suspension or termination of your server.

5. Refunds, Cancellation, and Termination

• Refund Policy:
  • A 7-day money-back guarantee applies to your first paid subscription.
  • Refunds do not apply to renewals, Free Credits, or accounts terminated for violations.
• Cancellation: You may cancel any time through your account dashboard. Your server will remain active until the end of the billing cycle.
• Termination by Us: We may suspend or terminate your account if you:
  • Violate these Terms.
  • Misuse free credits or promotions.
  • Engage in fraudulent or abusive behavior.

6. Acceptable Use

You agree not to use the Service for:

• Illegal activity under U.S. or international law.
• Uploading or distributing malware, spam, or phishing content.
• Infringing third-party intellectual property rights.
• Harassment, hate speech, or obscene content.
• Running non-Minecraft applications unrelated to server hosting.
• Excessive use of resources that interferes with other Users.

7. User Content and Backups

• You retain ownership of all content uploaded to your server, including mods, worlds, and configurations.
• By using the Service, you grant us a license to host, transmit, and back up your content as necessary to operate the Service.
• While we may offer backups, we do not guarantee data recovery. You are responsible for maintaining your own backups.

8. Service Availability

• We aim to provide 99.9% uptime but do not guarantee uninterrupted service.
• Maintenance, updates, outages, or events outside our control may cause downtime.
• We are not liable for downtime, delays, or data loss.

9. Limitation of Liability

• To the maximum extent permitted by law, our liability for any claim arising out of the Service is limited to the amount you paid us in the 30 days prior to the claim.
• We are not liable for indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption.

10. Pricing and Changes

• We reserve the right to change prices, plans, or features at any time.
• Existing subscriptions will be notified at least 14 days in advance of price increases.
• Continued use of the Service after changes constitutes acceptance.

11. Intellectual Property

• All software, branding, trademarks, and content created by us remain our property.
• You may not reverse engineer, copy, or redistribute our proprietary systems.

12. Privacy

Your use of the Service is subject to our Privacy Policy, which explains what data we collect, how it’s used, and your rights.

13. Governing Law and Disputes

• These Terms are governed by the laws of the State of Texas, United States.
• Any dispute shall first attempt resolution through informal negotiation. If unresolved, disputes will be handled exclusively in the state or federal courts located in Harris County, Texas.
• You agree to personal jurisdiction and venue in these courts.
